Calls to Increase Dani Alves’ Rape Sentence: Spanish Prosecution and Victim Seek Justice

The Spanish state prosecution agency and the victim, who were defendants in Dani Alves’ rape case, are jointly appealing to increase the player’s sentence. Alves, the former Brazilian footballer, is currently serving a four-and-a-half-year sentence after being found guilty of rape.

The initial sentence took into account Alves providing €150k in damages to the victim as a mitigating factor, resulting in a reduced sentence. However, both parties argue that this amount does not align with Alves’ financial means and should not have influenced the sentencing.

The minimum sentence for Alves’ offense is four years, while the maximum is twelve.

While the victim’s lawyer has yet to formalize their appeal, the state prosecution plans to challenge the mitigating circumstance due to Alves’ lack of acceptance or remorse. Alves’ defense seeks bail during the appeals process and aims to further reduce the sentence.

If deemed adequately compensated, Alves could see his sentence reduced to two years, considering time already served. Additionally, there is a possibility of early release on day parole as soon as July this year or potential release for good behavior after serving three-quarters of the sentence.
