Toce had been sentenced to 10 years in prison for having forceful carnal knowledge of the daughter of his third wife Mary. The little girl was just 15 at the time.

The girl revealed that Toce slept with her on several occasions in the home and in motels.
Unfortunately, she got pregnant with his baby but had an abortion after a few weeks.
Toce ended up serving only two and half years in prison.
