High Court Clears Tobinco of Fake Drug Import Allegations

The High Court in Accra has cleared Tobinco Pharmaceuticals Limited (TPL) and its Group Chairman, Elder Dr. Samuel Amo Tobbin, of allegations related to importing fake drugs.

The court, presided over by Her Ladyship Audrey Kocuvie-Tay, ruled on July 29, 2024, that Tobinco had not imported counterfeit drugs into Ghana.

Tobinco Pharmaceuticals had previously filed a lawsuit against the Food and Drugs Authority (FDA) on July 19, 2019, accusing the FDA of misusing its statutory powers.

The company claimed that the FDA, under the leadership of former Chief Executive Officer Dr. Stephen Kwabena Opuni, wrongfully targeted it between September and December 2013, alleging the importation of fake drugs.

According to Tobinco, the FDA’s actions included locking the company’s warehouses nationwide, which led to significant embarrassment.

Additionally, the FDA had banned Bliss GVS Pharma Limited, Tobinco’s then-principal business partner, from exporting drugs to Ghana and labeled their products as counterfeit, resulting in the confiscation of drugs from customers.

The court’s ruling stated that the FDA’s actions were unlawful, including their prohibition on Tobinco’s sales and the barring of Bliss GVS Pharma Limited from exporting drugs to Ghana without proper authorization from the Ministry of Health.
