Court of Appeal to Decide on Ablakwa vs. Rev. Kusi Boateng Contempt Case

The Court of Appeal is poised to render a critical decision on a defamation lawsuit brought by Reverend Victor Kusi Boateng against Member of Parliament for North Tongu, Samuel Okudzeto Ablakwa.

The case seeks to restrict Ablakwa from discussing Rev. Kusi Boateng in relation to the National Cathedral project.

This marks Rev. Kusi Boateng’s third attempt to secure such an injunction, following previous unsuccessful bids. In July last year, the Human Rights Court dismissed a similar application filed earlier in May.

Rev. Kusi Boateng, a contentious figure on the National Cathedral project’s board of trustees, hopes to reverse his fortunes with newly presented legal arguments.

Represented by Thaddeus Sory, Ablakwa has been present throughout the proceedings. Conversely, Rev. Kusi Boateng, though absent, is represented by his legal team led by Bobby Banson.

In a notable development, Thaddeus Sory has challenged the constitutionality of the panel constituted to adjudicate the case, alleging procedural irregularities that could compromise a fair trial under Article 13 of Ghana’s constitution.

Sory has raised concerns about the panel’s composition, specifically questioning the removal of Justice Dzamefe and the subsequent reconstitution process, which he argues deviates from established norms.

In response, Bobby Banson countered Sory’s assertions, dismissing them as hearsay lacking legal basis.

Currently, the judges are deliberating on these crucial matters, with the decision expected to have significant implications for the ongoing legal dispute and its media coverage.
