At a status hearing held on August 9, 2006, about the January charges, Franklin County Common Pleas Judges David Fais increased Clarett’s bond to $1.1 million. This was due to Clarett’s arrest earlier in the morning.

This hearing had not been requested by either the prosecution or Clarett’s defence team but was requested by Fias himself. At the hearing, Fais delayed the trial until September 18, 2006, revoked the $1.1 million bond in the case and ordered Clarett to undergo a mental health evaluation.
