The altercation occurred shortly after 8 p.m. on Wednesday, August 24 . A widely circulated video showed Upton launching a profanity-laced rant at the Indian Women.
Esmeralda Upton questioned their presence in the United States, threatening to shoot them, and physically assaulting Banerjee, who was filming the confrontation on her phone.

Esmeralda Upton was arrested on Thursday August 25 and charged with misdemeanor assault and terroristic threat, according to Plano police. She was arrested and her bond was set at $10,000.
Rani Banerjee one of the victims told Dallas TV station WFAA that Upton approached her and three friends in the parking lot after they had just finished eating dinner at a restaurant.
The Council on American-Islamic Relations condemned the attack. The police statement said the incident was being investigated as a hate crime. Jail officials had no attorney listed for Upton.
