Gina Carano has successfully prevented Disney from dismissing her lawsuit over her firing from the Disney+ series The Mandalorian.

A California judge, Sherilyn Peace Garnett, ruled against Disney’s attempt to have the case thrown out, meaning Carano’s discrimination lawsuit is set to proceed to trial.

Judge Garnett’s decision, issued on Wednesday, 24 July, 2024 criticized Disney’s argument that Carano’s presence as an employee would harm their values.

The judge noted that Disney and its affiliates, including Lucasfilm and Huckleberry Industries, are for-profit entities rather than nonprofit organizations like the Boy Scouts, and thus do not have the same rights to exclude individuals based on ideological differences.

Disney’s firing of Carano in 2021 stemmed from her controversial social media posts, which the company claimed were offensive and trivialized the Holocaust.

Carano, who played Rebel shock trooper Cara Dune on the show, has argued that her comments were misinterpreted and that she was unfairly labeled as an extremist.

No trial date has been set yet, but Carano’s lawsuit remains active, and the possibility of a settlement remains. Disney has not yet commented on the judge’s ruling.
