Harvey Weinstein Retrial in NYC Tentatively Scheduled for November

A judge has tentatively scheduled Harvey Weinstein’s retrial on rape and sexual assault charges to begin on November 12. The decision came during a brief court appearance on Friday, July 19, in Manhattan, which was delayed by over 90 minutes due to a global computer disruption, as explained by Judge Curtis Farber.

Weinstein, donning an American flag pin on his jacket, appeared in court where issues related to the evidence were discussed. This included the review of information from phones by a former judge to determine the relevance and potential disclosure to the defense.

At a previous hearing, prosecutors anticipated a November retrial, although they acknowledged that new claims against Weinstein had not yet been presented to a grand jury. Weinstein, who denies all allegations of sexual assault, is eager to proceed. “He is anxious to go to trial and prove his innocence,” stated Diana Fabi Samson, one of Weinstein’s attorneys, outside the courthouse.

Weinstein, 72, is currently incarcerated on Rikers Island. His attorney, Arthur Aidala, has raised concerns about Weinstein’s health, citing inadequate care for his diabetes, macular degeneration, and fluid in his lungs and heart.

While Aidala was not present on Friday, another attorney, John Esposito, mentioned that the defense reiterated these health concerns during a sidebar conversation with the judge. Farber assured that he would assist as much as possible to ensure Weinstein receives proper care. Esposito emphasized the preference for Weinstein to be moved back to Manhattan’s Bellevue Hospital for adequate medical attention, ensuring his readiness for trial.

Weinstein was treated at Bellevue for several days after his transfer to New York City earlier this year when the state’s highest court overturned his 2020 conviction. The appeals court determined that the original trial judge had unfairly permitted testimony based on uncharged allegations.

Despite the overturned conviction, Weinstein remains in jail due to a 16-year prison sentence in California following a 2022 rape conviction. An appeal in that case is pending, with a resolution not expected for at least another year.

Weinstein’s New York conviction had been a significant moment in the #MeToo movement, which gained momentum in 2017 with numerous allegations of sexual misconduct against the influential studio executive behind films like “Pulp Fiction” and “Shakespeare in Love.” He had been convicted of third-degree rape of an aspiring actress and of sexually assaulting a TV and film production assistant in 2006.

Prosecutors have indicated that Jessica Mann, one of the accusers in the original case, is prepared to testify again. Gloria Allred, the lawyer representing the other accuser, Mimi Haley, stated last week that Haley had not yet decided on her participation in the retrial.

The Associated Press typically withholds the identities of sexual assault victims unless they consent to being named, as Haley and Mann have done.
